Basin Electric supports Fair Compliance Act of 2011

The Fair Compliance Act would create one manageable timeline for industry to meet proposed regulations.

In late November, Basin Electric sent a letter to Sens. Joe Manchin III (D-WV) and Dan Coats (R-IN) to express support for their bill S. 1833, the Fair Compliance Act of 2011.

The legislation would delay two expensive Environmental Protection Agency regulations that pose major challenges for utilities. The proposed Utility MACT (maximum available control technology) requiring coal-based plants to achieve 91 percent reduction of mercury and other emissions, and the Cross-State Air Pollution Rule, which imposes caps on sulfur dioxide and nitrogen oxide that drift across borders, have extremely difficult compliance deadlines.

The Fair Compliance Act would streamline the compliance deadlines for these two rules, creating one timeline for industry to meet the requirements of both regulations.

"Basin Electric believes your legislation will help address not only the difficult compliance deadline issue of the Utility MACT, but also enable better coordination between the utilities and the electric reliability organizations," the letter states. "This will ensure that a thoughtful and constructive plan is in place to provide a stable flow of power to the transmission grid when these units are off line being retrofitted."
