A ruling upheld by the U.S. Court of Appeals today ordered BNSF Railway to pay about $345 million in payments and rate reductions to Basin Electric Power Cooperative.
The court says BNSF was using its monopoly power to overcharge customers in North Dakota. The original decision by the Surface Transportation Board ordered the railway to lower its transportation rates by about 60 percent saying the railway's rates exceeded the lawful limit.
